            Sub: Constitution of Complaints Committee for dealing with Complaints of

Sexual harassment at work place for Mumbai Custom Zone-I – regarding.

 

            In pursuance to the guidelines laid down by the Hon’ble Supreme Court, for prevention of sexual harassment of women in work places, vide its Judgement in the case of Vishakha & Others Vs State of Rajasthan & Others (AIR 1997 SC 3011) and further instructions issued by the Ministry of Finance, Department of Revenue vide F. No. C-30013/20/98- Ad IV A dated 07.04.99 and the “Code of Conduct” prepared by National Commission for Women, a Complaints Committee was constituted in Mumbai Customs Zone vide this Office Order F. No. S/II-8 (11)/CCO/99 dated 22.09.1999. The basic aim of the Complaints Committee is to look into the complaints of sexual harassment of Women at the work place.  The Committee has since been constituted from time to time.

 

2.         It has now been decided to reconstitute the said Complaints Committee for Mumbai Custom Zone- I. Accordingly, in supersession of all the previous orders on this subject, the following officers are nominated as Chairperson/Members of the Complaints Committee:

3.         The Complaints Committee shall meet at regular intervals to discuss various issues concerning women and steps required to be taken for redressal of grievances, if any.  The Committee shall also initiate necessary measures to ensure appropriate working conditions, to promote health and hygiene among women so that women employees do not remain in disadvantageous position.  The Committee shall also organize special programmes/seminars for the betterment of the women employees.

 

4.         The Complaints Committee shall prepare an Annual Report giving full account of the activities carried out by it during the year and forward copy of the same to the Chief Commissioner of Customs, Mumbai Zone- I for information and necessary action, if any.

 

5.         The Addl./ Jt. Commissioner of Customs (P & E), New Custom House, Mumbai, will coordinate the working and proceedings of the Committee.

3.                  To coordinate with the Systems Manager (EDI) to ensure that the raw import data goes on daily basis to DOV and to ensure that analysed weekly data received from DOV is posted on to the intranet.

4.                  To monitor number of hits by Appraisers, Assistant / Deputy Commissioners of Import Commissionerate of NCH, Mumbai for NIDB data on intranet and report to the Commissioner of Customs, Import on discrepancies noticed for taking necessary action.

                        Sub: Drawal of Seniority list of officers in the grade of Customs

                        Draft Seniority list in respect of Mumbai Customs Appraisers,  is prepared in pursuant to directions contained in Ministry’s letter F.No.A-23011/1/2004-AD IIA dated 3.06.2008 for circulation and information of all concerned.  Any discrepancy with regard to the entries may be brought to the notice of the undersigned on or before 30.06.2008.  

 

Vide the above said letter it is directed to prepare the Seniority list  in accordance with the Hon’ble Supreme Court of India judgement dated 16-05-2008 regarding fixation of Inter-se-seniority between the directly recruited Customs Appraisers and promoted from the level of Examiners / Preventive Officers and Ministerial Staff based on the guidelines / principles for preparation of the seniority list is given below:

  1. Fixation of Seniority of Officers appointed before publication of 1961 Rules:

 

    1. The seniority of direct recruit and promotee officers appointed prior to the notification of Rules of Recruitment of 1961 may be fixed by rotation of vacancies as decided by Hon’ble Supreme Court in Mervin Coutino’s case, as followed while drawing the seniority list on previous occasions.  The Govt. of India instructions dated 22.12.1959 may be referred to in this regard.
    2. The group of officers mentioned at Sr.No.1 above shall rank en-bloc senior to those appointed after notification of the Rules.

    B.  General Priniciples as communicated by Supreme Court in G.B.Yadav’s case:

 

3.      The seniority of officers appointed after notification of Rules of Recruitment in the year 1961 may be fixed on the strength of their “continuous officiation” as decided by Hon’ble Supreme Court of India in its judgement dated 08.05.1966 in G.B.Yadav’s case and interpreted in subsequent cases.

    1. While computing the length of continuous officiation it has to be ensured that the officers concerned have been regularly appointed  in terms of Rule 3 & 4 of the Rules of Recruitment of 1961 or the relevant provisions of the amended Rules of 1988.

   C. Seniority of officers regularised up to 31.12.1987

 

    1. The promotees who have been regularised upto 31.12.1987 shall be placed on the seniority list based on the length of their continuous officiation in terms of Para 50A of the judgement of Hon’ble Madras High Court.

  D. Seniority of Ad-hoc appointees up to 31.12.87 regularised subsequently

 

    1. The officers who were promoted on adhoc basis up to 31.12.1987 with in the prescribed ceiling of 50% for promotion, as per rules, initially on adhoc basis and subsequently regularised shall be entitled to count their length of adhoc service w.e.f. the date they are promoted on ad-hoc basis as Appraiser for computation of the period of continuous officiation for determination of seniority in terms of Para 50B of the judgement of Hon’ble Madras High Court.
    2. The officers who have been appointed on adhoc basis up to 31.12.1987 in excess of the prescribed ceiling of 50% for promotion shall not be entitled to count their ad-hoc service for computing the length of continuous officiation for determination of their seniority in terms of Para 50B of the judgement of Hon’ble Madras High Court.  The length of continuous officiation of such officers shall be counted from the date of their regular promotion and not from the date of their adhoc promotion.

  E. Seniority of Direct Recruits

 

8.      The seniority of officers appointed on direct recruitment shall be fixed on the strength of their actual appointment computing the length of their continuous officiation from the date of such appointment in terms of Para 50 C of the judgement of Hon’ble Madras High Court.

F. Seniority of Officers appointed as Customs Appraisers after 31.12.1987

 

9.      Even after publication of the amended Rules of Recruitment in the year 1988 wherein a definite quota of vacancies has been fixed in the ratio of 50:50 for direct recruits and promotees, the seniority need not be on the basis of rotation, in terms of Para 50 E of the judgement of the Hon’ble Madras High Court, since no specific instructions for fixation of seniority by rotation has been issued after publication of amended  Rules of Recruitment in the year 1988.

    1. The seniority of officers appointed to the grade of promotion or Direct Recruitment within the number of vacancies coming to the share of their respective stream, shall be determined on the strength of their actual date of appointment on regular basis for the purpose of computation of length of continuous officiation.
    2. The officers who are appointed against vacancies in excess of the share of their respective category shall be pushed down  to be adjusted against the quota of the category concerned during the subsequently years, in terms of Para 50 D of the judgement of Hon’ble Madras High Court. The length of continuous officiation of such officers after regularisation/ adjustment in their quota shall determine their seniority.

  G. General Principles

 

12.  While computing the length of continuous officiation of an officer, if any officer junior to him in the panel in case of a promotee officer and in the rank of examination in case of a direct recruit officer has a date of appointment prior to that of the senior, the date of appointment of the senior will be ante-dated with reference to that of the junior.

    1. All the officers will be placed on a single seniority list based on length of ‘continuous officiation’, the officers with longer period ranking senior to those with shorter period of such officiation.

 H. Implementation of Court Judgements on the subject.

 

    1. If a petitioner (s) is grated a relief in personam i.e. in individual cases, in the matter of regularisation / fixation of seniority pursuant to the implementation of any Court Judgement , the benefit so granted need not be withdrawn in order to conform the principles stated above for fixation of seniority.
    2. This issues with the approval of Commissioner of Customs (General).
