chaired the meeting. He welcomed all the members and took up the previous
points and the agenda for discussion with the members.
4. Duty
Chargeable on Submarine Cables:
The matter is being
pursued with the Board for early clarification.

1. NOC from
PHO in the assessment of Crude Glycerine:
Shri J. Lapsia had raised the point
that while assessing commodity like crude Glycerin the system demanded an NOC
from PHO whereas the commodity being an industrial use item, such NOC was
not required.
In this regard, it was to
informed that the matter has already been referred to the RMD, Mumbai for
necessary action vide letter No. S/16-Misc-22/2010 dated 28/6/2010
requesting for RMS instruction at the time of examination of imported Crude
(Glycerin/ Crude Palm Stearine).
It was informed by Sh. Lapsia that the
department was not demanding the NOC for PHO in such cases. Since, the issue is between the
department and RMD, the point may be treated as closed.
New Points:
1. CHA directory updation for ICES 1.5
As per public Notice No. 20/2010
dated 28/05/2010 of Commissioner of Customs (I) and P.N. No. 13/2010 dtd
22/04/2010 of Commissioner of Customs (G) the CHAs were requested to give
data for updation of CHA directory for rolling of ICEs 1.5.
Most of the work is already done
in this matter. The association may please be in touch with the CHA section
to complete the work of updation at the earliest. The point may be treated as closed.
2. B.E.
pendency
As on date (21/07/2010 ) there were
814 Bill of Entry which were assessed but duty not yet paid. The EDI System
shows that the duty amount involved is Rs. 52.4 Crores. The detailed list of these B.E. : CHA wise as
contained in the CD was handed over to Shri Nailesh Gandhi of BCHHA . The
CHAs may check up the present status whether still pending and if so then
pursue for duty payment as interest is liable to be paid as per section 47
(2) of Customs Act 1962.
Asstt. Commr. Of Customs, EDI vide letter
dt. 11/10/2010 sent fresh CD containing the CHA wise list of Bills of entry
pending for duty payment for the period 1999 to 08/10/2010 for further
action by CHA. Instead of reduction in the pendency of Bills of Entry, it
has increased to 848. It is, therefore, felt that concrete efforts in this
regard are to be made for liquidation by the Association. The latest CD
containing list of 848 pending Bills of Entry was handed over to Sh. Kiran
Rambia, member of BCHAA.
Sh.
S. K. Rahman, Addl. Commr. of Customs discussed at length how to close the
Bills of Entry in the system with the association and the members of
association assured the chairman that they will take up the matter urgently
with their association members.
3. High Sea
Sale:
The Standing Order has already
been issued; however, the member of CHA association pointed out that the
Dy. Commissioner of Customs, Gr. IIA was not accepting the High Sea Sale
transactions without loading of 2% on the invoice value. The chairman
directed CHA to approach Joint Commr. Gr. IIA to resolve the matter. The
point may be treated as closed.
NEW POINTS
1.
The chairman discussed whether the association would like to have
Union Bank of India,
Baazar gate Branch, Mumbai for physical collection of duty. All the members
agreed to the proposal as they feel that to have more banks for duty
collection will be easier for them. The chairman told them that he would
recommend the name of the Union Bank of India, Baazar gate Branch,
Mumbai for the above purpose.
The next Trade Facilitation
Meeting will be held on 24/11/2010 at 5 p.m. in the conference hall, New
Custom House, Mumbai. The points sponsored for discussion for the next
meeting may be sent by 10.11.2010 to the Addl. Commissioner of Customs
(Appraising General) (Import), New Custom House, Mumbai.

The issue was
discussed in the meeting. The chairman informed the member that the
necessary clarification has already been received in this matter and the
Public Notice will be issued shortly.

2. B.E. pendency
As on date (21/07/2010) there are

Shri Kiran Rambia
requested to issue a fresh list as the earlier list was issued two months
earlier and many B.E. might have been closed by now. It was ordered to provide them the latest
list by pending Bills of Entry.
Incidentally, members of the BCHHA
mentioned that Asstt. Commissioner of Customs, Group VB, has issued a
letter to one of their member M/s Nagarkot Forwarders Pvt. Ltd. requesting
them to give the present status of the Bills of Entry of their client
pending for payment of duty and clearance of goods failing which action
will be initiated against them as provided in law. The members of BCHAA
have taken the wording as offending since they have no role to play if the
importer is not paying duty and clearing the goods. They can only pursue
the importer. Their sentiments were noted. However, it is noticed that the
Asstt. Commissioner of Customs has written a letter consequent to a Note
dtd. 20/08/2010 wherein the Commissioner directed ACs/DCs to take up the
matter with the CHA to set the duty paid within 15 days failing which the
department may refer the matter to MbPT for auction of the goods. It
appears that it is a slip on the part of the Asstt. Commissioner of Customs
& no action can be taken against CHA in such cases.

3. High Sea Sale:
- Shri Omprakash
Agarwal said that the Standing Order issued by the Commissioner (Import) is
not available on the Customs website. He wanted to see the copy of Standing
Order No 17/2010 dt. 20/07/2010, the Chairman had provided him the copy of
the said Standing Order. The Chairman also dircted to put the said Standing
Order on Customs website.

2. SAD refund
of 4%:
The Point was raised by Shri
Pankaj Shah from BCHAA that the original copy of B/E as well as original
challan was required to be produced at the time of audit by Sale Tax Department
etc. So it was
requested that at the time of filing the 4% SAD refund claim the original
documents after certifying the same by Appraising Officer may be returned
to CHA / Importers and the certified copies may be used for processing the
refund claim. Suggestion shall be examined.

Action : As referred by DC/CRARS the original copies of B.E. are required
for endorsement after sanction of 4% refund. Therefore, only after
endorsement, the B.E can be given back to CHA/Importer.

3. Valuation
of High Sea
– Sale
:
The point was raised by Shri J.
Lapsia from AILBIEA as to whether
the addition of commission of 2% on invoice value in High Seas Sale
is required or not as per Board’s Circular no. 32/2004.
The Standing Order No. 17/2010
dated 20.07.2010 has been issued in this matter. The point may be treated as
closed.
New Points:- Copies of B.E. etc are not sometime generated in the EDI
system and that there may be same problem in the system.
The Additional Commissioner, EDI Shri S.K. Rahman requested for reporting specific incidents , so that the necessary action can be taken to
solve the problem.

The member further enquired as
to whether it was necessary to get them registered in ACES 1.5 even though they are already registered
at other port viz Mulund CFS etc.
The Addl.Commissioner EDI
replied that he will look into the matter and inform accordingly.

COMMITTEE MEETING HELD ON 09.06.2010 AT 16.30 HRS
The monthly meeting of the Trade
Facilitation Committee was held on 09.06.2010 at 16.30 Hrs in the
Conference Hall, 2nd Floor, New Custom House, Mumbai. Shri Sujit K. Sinha, Commissioner of
Customs (E.P.) chaired the meeting.

2. The Chairman welcomed the Members
of the Trade. As has been seen from
the previous Minutes, the Chairperson noticed that only Members of BCHAA
have regularly attended the TFC Meetings and the Members of other
Associations have not attended. In
this regard, the Chairman suggested to convey to all Members of other
Associations and even Association of Shipping Lines to attend the Meetings,
so that the purpose of conducting the Trade Facilitation Meetings will be
served.
3. The Members of the BCHAA raised the
issue of problems faced in getting Drawback Benefits. Shri Nilesh Gandhi pointed out that the
major reason for non sanction of Drawback is EGM error, which can be on two
counts, where the details on the Shipping Bill and the Export General
Manifesh do not tally. In some
cases, where the LEO date is not entered by the shed PO before the EGM is filed, in such
cases the entire EGM filed by the Shipping Line will show error. The Commissioner proposed that for
effective solution of the problem, a meeting with representatives of the
Shipping Lines should be held for proper appreciation of their problems and
requirement. He also requested that
even the BCHAA should also request the representative of the Shipping Lines
to attend the next TFC Meeting. The
Members of the Trade and CHA Association confirmed that they have circulated
the list provided by the Department and requested all the Members of BCHAA
to approach the exporters so that they can provide necessary documents /
clarifications in settlement of pending Drawback claims. The Members of the
BCHAA further stated that in old Drawback cases where action is pending for
want of Test Reports, in case of regular imports, the previous Test Reports
may be considered to finalize such cases.
The Chairman assured that he will look into the matter for taking
appropriate decision on this issue.
4. Shri Pankaj Shah stated that there
is large number of cases of Refund pending for finalization. They further stated that the Ledger
Accounts is a sufficient proof to verify whether the Applicant has passed
on the burden of duty to others. They further added that as per the Board
Circular, SAD Refunds are not as per Section 27 of the Customs Act, 1962,
and Ledger Accounts certified by the CA should be accepted. The Chairman
stated that he is aware of the issue and a reference has already been made
to the Board, still he will look into the matter.
5. Shri Nilesh Gandhi also raised an
issue that the present procedure of resorting to back to town of exports
goods in case of shutting down of cargo by the Shipping Line is cumbersome
and time consuming and requested that a simpler and speeder process be
adopted. The Chairperson stated that
he will look into the procedure and consider the request after examining
the issue in detail.
6. Shri Nilesh Gandhi further raised
that the procedure of drawing of samples for testing purpose are
cumbersome. He stated that many
samples, which were drawn from Docks, were not available in the Department,
therefore the Test Reports for these samples could not be obtained from the
DYCC. The Chairperson ensured that
he will look into the matter and do the needful after examining the
issue. Shri Gandhi brought to the
notice of the Chairman, a pending Drawback claim of M/s. Gujarat Ambuja
Cement under Section 74. The
Chairman assured to expedite the matter.
7. The next meeting of the Trade
Facilitation Committee is scheduled to be held on 14.7.2010 at 16.30 Hrs in
the Conference Hall, 2nd Floor, New Custom House, Ballard
Estate, Mumbai. The Members are
requested to send the Agenda on or before 9.7.2010 to the Fax no. 22671113.

The Commissioner of Customs (EP)
welcomed the Trade Members.
1. The
Commissioner (EP) enquired about the status of the two issues raised in the
last meeting viz. non-submission of detention and demurrage charges on
import of bulk cargo as a result of which many provisional assessment are
pending in the group and Bills of Entry pending in the EDI System.
Shri Pankaj Shah of BCHAA informed
that they have received list of B/Es pending in EDI System but have not
received the lists of the pending provisional assessment.
2. In
respect of delay in processing the refund claims, members have been
informed that normally processing is done on the basis of age of refund
which is determined from the date of filing. It was also informed to members that two
ACs, Shri Pramod Kumar and Shri Y.S. Reddy have been given 150 cases each
to clear the backlog. The issue was
also raised whether refund can be processed in cases where no accounts have
been presented to scrutinize whether the cases are covered by the bar of
‘unjust enrichment’.
Such cases are kept pending and will be disposed when the financial
year is over.
It was also raised that in cases
where only Ledger accounts have been submitted can the refund be
processed. The matter has been
referred to Chief Commissioner’s Unit for clarification.
3. The
next meeting of the Trade Facilitation Committee is scheduled to be held on
14.04.2010 at 16.30 Hrs in the Conference Hall, 2nd Floor, New
Custom House, Ballard Estate, Mumbai.
